1. Acceptance of Terms

By accessing or using 312eats.com (“the Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Site.312 Eats (“we,” “us,” or “our”) reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

312 Eats is a restaurant directory for the Chicago area. We provide:

• A searchable directory of restaurants ranked through our data-driven evaluation process using AI analysis of real Google reviews
• Restaurant profiles with ratings, cuisine types, dietary information, vibe tags, must-order dishes, and neighborhood details
• An inquiry system that connects diners with restaurants for reservations, catering, private events, and general questions
• Tools for restaurant owners to claim and manage their profiles

3. Directory Information

Restaurant listings on 312 Eats are generated from publicly available data, including Google Business profiles and reviews. While we take care to ensure accuracy through our multi-step data pipeline, we make no guarantees that all information is complete, current, or error-free.

Tier designations (Essential, Recommended, Hidden Gem, Listed) are based on our internal quality scoring methodology — including AI-generated food, service, and ambiance scores derived from real review analysis — and reflect data-driven assessments, not endorsements, certifications, or guarantees of quality. Tiers may change as new data becomes available.

Ratings and reviews displayed on the Site are sourced from Google and reflect the opinions of individual reviewers. 312 Eats does not verify the accuracy of individual reviews and is not responsible for their content.

AI-generated content such as profile descriptions, highlight quotes, must-order dishes, vibe tags, and dietary information are derived from analysis of publicly available review data. While we strive for accuracy, this content is generated algorithmically and may contain errors or become outdated.

4. Inquiries & Contact Requests

When you submit an inquiry through the Site (such as a reservation request, catering inquiry, or private event request), you agree to the following:

• You are providing accurate contact information and request details
• The restaurant you contacted will receive your name, phone number, email, and message so they can respond to you
• 312 Eats facilitates the introduction but is not a party to any agreement, transaction, or arrangement between you and the restaurant
• 312 Eats is not responsible for the quality, availability, pricing, or outcome of any dining experience or service provided by a restaurant

5. Restaurant Accounts & Subscriptions

Restaurant owners may claim their profiles by verifying their identity and business information. Some features on the Site may require a paid subscription.

5.1. Free & Paid Tiers

We offer both free and paid subscription tiers. Paid tiers may offer additional features such as enhanced profile visibility, analytics access, or promotional placement. We reserve the right to modify the features offered in each tier at any time.

5.2. Billing & Payments

By subscribing to a paid plan, you agree to pay all applicable fees. Payments are processed securely through our third-party payment processor (Stripe). We do not store your credit card information directly. Subscriptions automatically renew at the end of each billing period unless canceled.

5.3. Cancellations & Refunds

You may cancel your subscription at any time through your dashboard. Cancellation will take effect at the end of your current billing period. All fees are non-refundable, and we do not provide refunds or credits for partially used billing periods.

5.4. Restaurant Owner Conduct

By claiming a profile, restaurant owners agree to:

• Provide accurate and current business information
• Respond to diner inquiries in a timely and professional manner
• Not misrepresent their restaurant's offerings, cuisine, or dietary options
• Accept that 312 Eats may adjust their tier designation based on updated review data

We reserve the right to suspend or remove any restaurant listing that violates these terms or that we believe misrepresents the restaurant's offerings, without refund.

6. Intellectual Property

The Site's design, layout, text, graphics, logos, and software are owned by 312 Eats and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from the Site's content without our written permission.

Restaurant data displayed on the Site (names, ratings, reviews) is sourced from public records and third-party platforms. 312 Eats's original analysis, quality scores, tier designations, AI-generated profile descriptions, food/service/ambiance scores, and editorial content are our intellectual property.

7. Prohibited Uses

You agree not to:

• Scrape, crawl, or automatically collect data from the Site beyond what is permitted by our robots.txt
• Submit false, misleading, or spam inquiries
• Impersonate a restaurant owner or claim a profile that is not yours
• Attempt to interfere with the Site's operation, security, or infrastructure
• Use the Site for any unlawful purpose

8. User-Submitted Content

8.1. Tips & Corrections

You may submit tips, suggestions, and factual corrections about restaurants listed on 312 Eats. By submitting content, you:

• Grant 312 Eats a perpetual, non-exclusive, royalty-free license to use, display, modify, and distribute your submission
• Represent that your submission is accurate to the best of your knowledge
• Understand that all submissions are subject to review and moderation before publication
• Acknowledge that 312 Eats may edit, reject, or remove submissions at its sole discretion

8.2. Content Guidelines

Submissions must not contain:

• False or misleading information
• Promotional content or spam
• Offensive, discriminatory, or defamatory language
• Personal information about restaurant staff or other users
• Content that violates any applicable law

8.3. Moderation

312 Eats reviews all user submissions before publication. We reserve the right to approve, edit, or reject any submission without notice or explanation. Approved corrections may be applied directly to restaurant listings.

9. Analytics & Tracking

By using the Site, you acknowledge that we use the following third-party tools:

• Plausible Analytics: a privacy-friendly, cookie-free analytics service that collects anonymized usage data (page views, referrers, device type). No personal data is collected.
• Meta (Facebook) Pixel: used to measure advertising effectiveness and create targeted audiences on Facebook and Instagram. The Pixel may collect browsing data and set cookies on your device. You may opt out via your Facebook Ad Settings.

10. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The Site will be uninterrupted, error-free, or secure
• Restaurant information will be accurate, complete, or current
• Any restaurant will meet your expectations or provide a satisfactory dining experience
• Results obtained through the Site will be reliable

You acknowledge that choosing a restaurant involves personal preferences and that you are solely responsible for verifying a restaurant's current hours, menu, pricing, and availability before visiting or making a reservation.

11. Limitation of Liability

To the fullest extent permitted by law, 312 Eats shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Site or any restaurant experience facilitated through the Site.

Our total liability for any claim arising from your use of the Site shall not exceed $100.

12. Indemnification

You agree to indemnify and hold harmless 312 Eats, its owners, operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your interaction with any restaurant.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts located in Cook County, Illinois.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
